By accessing or using dvcard.biz, you agree to be bound by these Terms. Please read them carefully before using our services.

We reserve the right, at our sole discretion, to modify or revise these Terms of Service in whole or in part at any time. THE AGREEMENT TO ARBITRATE REQUIRES THAT YOU SUBMIT CLAIMS YOU HAVE AGAINST DVCARD.BIZ TO BINDING AND FINAL ARBITRATION, AND FURTHER (1) YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST DVCARD.BIZ ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, (2) YOU WILL ONLY BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ON AN INDIVIDUAL BASIS, AND (3) YOU MAY NOT BE ABLE TO HAVE ANY CLAIMS YOU HAVE AGAINST DVCARD.BIZ RESOLVED BY A JURY OR IN A COURT OF LAW.

1. Acceptance of Terms

By accessing or using dvcard.biz, you agree to these Terms, and you represent and warrant that you have the legal authority to enter into these Terms on behalf of yourself or the entity you represent. If you do not agree to these Terms, you may not access or use dvcard.biz.

2. Description of Service

dvcard.biz is a digital business card platform that allows users to create, manage, and share their digital business cards online. We provide tools and features to enhance your professional networking experience. Please note that we may update or modify the services provided by dvcard.biz from time to time, and such changes will be subject to these Terms.

3. User Accounts and Registration

In order to access certain features of dvcard.biz, you may need to create a user account. When registering, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Notify us immediately of any unauthorized use of your account.
You must be at least 18 years old to create a user account on dvcard.biz. If you are under 18, you may only use dvcard.biz with the involvement and consent of a parent or legal guardian.

4. User Content

dvcard.biz allows you to create and share content, including your digital business card information ("User Content"). You retain ownership of your User Content, and by uploading or sharing it on dvcard.biz, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display your User Content for the purpose of providing the services offered by dvcard.biz.
You represent and warrant that you have the necessary rights to grant the license described above, and that your User Content does not infringe upon the rights of any third party or violate any applicable laws or regulations.
We reserve the right to remove or disable any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

5. Prohibited Conduct

You agree not to use dvcard.biz for any unlawful, harmful, or inappropriate purposes. You may not:

Violate any applicable laws or regulations;
Infringe upon the rights of others;
Use dvcard.biz to send spam, unsolicited messages, or other unauthorized communications;
Attempt to gain unauthorized access to dvcard.biz or any user accounts;
Interfere with or disrupt the operation of dvcard.biz;
Use any automated means to access or use dvcard.biz, unless explicitly permitted by us.

We reserve the right to suspend or terminate your access to dvcard.biz if you violate any of these Terms or engage in any prohibited conduct.

6. Intellectual Property Rights

All intellectual property rights in dvcard.biz, including but not limited to copyrights, trademarks, and trade secrets, are owned by WEBCYPHER TECHNOLOGIES (OPC) Pvt. Ltd.or its licensors. You may not use, reproduce, modify, adapt, or distribute any part of dvcard.biz without our prior written consent.
You retain ownership of the intellectual property rights in your User Content. By uploading or sharing User Content on dvcard.biz, you grant us the license described in Section 4(a).

7. Disclaimer of Warranties

dvcard.biz is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that dvcard.biz will be error-free, uninterrupted, or secure.
We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You use dvcard.biz at your own risk.

8. Limitation of Liability

In no event shall WEBCYPHER TECHNOLOGIES (OPC) Pvt. Ltd. be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of dvcard.biz, whether based on contract, tort, strict liability, or other legal theory.
b. Our total liability to you for any claims arising from or related to these Terms or your use of dvcard.biz shall not exceed the amount paid by you, if any, for accessing the services provided by dvcard.biz.

9. Indemnification

You agree to indemnify, defend, and hold harmless WEBCYPHER TECHNOLOGIES (OPC) Pvt. Ltd. its officers, directors, employees, and agents, from and against any and all claims, damages, losses, liabilities, and expenses arising out of or in connection with your use of dvcard.biz or any violation of these Terms.

10. Modifications to the Terms

We reserve the right to modify or update these Terms at any time, and such modifications will be effective upon posting on dvcard.biz. You are responsible for regularly reviewing these Terms. Continued use of dvcard.biz after any modifications constitutes your acceptance of the modified Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, India.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

13. Entire Agreement

These Terms constitute the entire agreement between you and WEBCYPHER TECHNOLOGIES (OPC) Pvt. Ltd. regarding your use of dvcard.biz, superseding any prior agreements or understandings.

14. Your Privacy

At dvcard.biz, we respect the privacy of our users. For details please see our Privacy Policy at https://dvcard.biz/privacy-policy. By using the Service, you consent to our collection and use of personal data as outlined therein.

For Resellers using the white label:

15. Reseller Restrictions

Resellers utilizing the white label option are granted permission to customize and rebrand the dvcard.biz platform for their own business purposes. However, Resellers are strictly prohibited from using the term "dvcard.biz" in any form, including but not limited to the use of the word, screenshots of dvcard.biz, logo, or any other identifiable elements associated with dvcard.biz without obtaining written permission from WEBCYPHER TECHNOLOGIES (OPC) Pvt. Ltd.
Resellers must seek written consent from WEBCYPHER TECHNOLOGIES (OPC) Pvt. Ltd. for the use of any dvcard.biz branding elements, trademarks, or copyrighted materials. Unauthorized use of such materials is strictly prohibited and may result in legal action.
WEBCYPHER TECHNOLOGIES (OPC) Pvt. Ltd. reserves the right to review and approve any proposed usage of its branding elements by Resellers. Approval, if granted, will be provided in written form and will specify the scope and duration of the permission.
Resellers found in violation of these restrictions may be subject to termination of their white label agreement and legal consequences as per applicable laws.

Please ensure that you comply with these additional terms and restrictions as a Reseller utilizing the white label option of dvcard.biz.

Return and Refund Policy

At Dvcard.biz, we strive to provide excellent service and products to all of our customers. However, we understand that sometimes circumstances may arise that require the cancellation or refund of an order.

To request a cancellation or refund, please contact us within 24 hours of placing your order. If your order has not yet been processed, we will cancel the order and issue a full refund in 48 Hours. on the same mode of transfer.

If your order has already been processed, we will do our best to accommodate your request for a cancellation or refund. However, we cannot guarantee that the request will be granted.

In the event that a refund is approved, it will be issued in the same form as the original payment method. If you paid by credit card, the refund will be credited to the same credit card. If you paid by check or money order, a check will be issued.

Please note that any fees associated with processing your order (such as shipping and handling fees) are non-refundable.
